1. Acceptance of Terms

By accessing or using KOTH (“the Platform”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Platform.

2. Description of Service

KOTH is a decentralized prediction market platform that enables users to create and participate in prediction markets on Solana. The Platform facilitates on-chain transactions through smart contracts and does not hold custody of user funds.

3. Eligibility

You must be at least 18 years old and not a resident of any jurisdiction where use of the Platform is prohibited. By using the Platform, you represent that you meet these requirements.

4. Smart Contract Risks

All transactions on KOTH are executed by immutable smart contracts. The Platform does not control, modify, or reverse any on-chain transactions. You acknowledge and accept the following risks:

  • Smart contract vulnerabilities or exploits may result in total loss of funds
  • Token prices are determined by market dynamics
  • Tokens may lose all value and become worthless
  • Blockchain congestion may delay or prevent transactions
  • Regulatory uncertainty may affect the legality of operations

5. No Financial Advice

KOTH does not provide financial, investment, or legal advice. All participation carries high risk. You alone are responsible for your decisions and should consult a qualified professional before participating.

6. Fees

A fee is charged on winning payouts as described on the Platform. Fees are non-refundable. The Platform reserves the right to adjust fees with notice.

7. User Conduct

You agree not to:

  • Use the Platform for any illegal purpose or in violation of applicable law
  • Create markets that impersonate existing projects or individuals
  • Manipulate outcomes through coordinated schemes
  • Interfere with the proper operation of the Platform or smart contracts
  • Use automated systems to abuse Platform features

8. Intellectual Property

The KOTH name, logo, and interface design are proprietary. The smart contracts are open-source and licensed separately.

9. Third-Party Services

The Platform integrates with third-party blockchain and infrastructure services. The Platform is not responsible for the operation, security, or availability of these third-party services.

10. Chat Room Content

The Platform provides market-specific comment sections for community discussion. KOTH does not endorse, verify, or take responsibility for any content, statements, or links shared in comments. Users are solely responsible for their own messages and interactions. KOTH reserves the right to moderate or disable comment features at its discretion but has no obligation to monitor content.

11. No Refunds

All transactions on the Platform are final and irreversible. The Platform does not offer refunds, chargebacks, or cancellations for any reason, including lost funds due to user error, market conditions, or smart contract issues.

12. Limitation of Liability

To the maximum extent permitted by law, KOTH and its developers, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or funds, arising from your use of the Platform.

13. No Warranty

The Platform is provided “as is” and “as available” without warranty of any kind, express or implied. The Platform does not guarantee uninterrupted or error-free operation.

14. Indemnification

You agree to indemnify and hold harmless KOTH, its developers, and affiliates from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

15. Governance and Voting

The Platform may introduce governance mechanisms in the future. Participation in governance does not confer any ownership, equity, or profit-sharing rights.

16. Data Privacy

The Platform collects minimal on-chain data and optional off-chain data (such as wallet addresses for profile features). No personally identifiable information is required. Data is stored on decentralized infrastructure where possible.

17. Termination

The Platform reserves the right to restrict or terminate access to the frontend interface at any time without notice. Smart contracts will continue to operate independently on the blockchain.

18. Changes to Terms

These Terms may be updated at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. Users are encouraged to review these Terms regularly.

19. Governing Law

These Terms are governed by the laws of the Republic of Panama. Any disputes arising from these Terms shall be resolved through binding arbitration in Panama City, Panama.
